Aleria Carventus I think the only way it would be attempted murder is if he knew there was HIV on the needles, and if someone caught it from them. Barring that, there's no intent, and so nothing was "attempted". (I was/will be a law student) Yes but he knew the risks involved if he did not sterilize the needles so it could be considered intentional if someone got infected.

Nope, knowing the risks of something doesn't mean it's grounds for attempted murder. For example, someone speeding on the highway in poor conditions would be charged with criminal negligence, rather than attempted murder, even though he knew that by speeding he very well might kill someone. In order for an attempted murder charge to be successful, they must prove both intent and action.
For criminal negligence, it's a bit different - you must only prove that the accused acted without due care. So if I was the prosecuting lawyer, I would say that he knew the risks, due to having been in the tattooing industry for X number of years, and (assuming he had one) having taken the course to learn about blood-transmitted diseases, etc. This would be enough to show he had the knowledge that what he was doing was wrong, but not enough to show he had the intent to injure people by not utilizing proper sterilization techniques.
Edit: This is for Canada, of course. I don't know what the laws are like in the US.

Jagger-Wolf I know this article is from back in January, and I posted a comment in it, but I want to know what you all think of it too. http://zeldalily.com/index.php/2010/01/evidently-theres-a-direct-link-between-body-art-and-societal-deviance/ Basically, the article states that those who have a combined total of 4 or more tattoo, are more likely to skip class, be drunk in public, and other "deviant" behavior. Read the article and tell me what you all think. Just because you're pierced and tattooed, does that make you want to do more deviant behavior? Do you binge drink, get arrested for bar fights, etc., JUST because you have a combined 4 or more tattoos or piercings? I didn't read the article. I have a total 16 piercings, and NO tattoos. I NEVER drink. I have NEVER even touched a cigarette or abused any type of drug. Skip class? That was about the definition of my Senior year in High School. Somehow I still passed with A's and B's all year. Interesting that people make those kind of generalizations about the body mod culture.

i think that article is stupid because i have friends that drink have tattoos piercings and they all graduated from school and they're in college. the only thing to worry about is getting an std from the needles they use.

+Dark_NekoDemon+ i think that article is stupid because i have friends that drink have tattoos piercings and they all graduated from school and they're in college. the only thing to worry about is getting an std from the needles they use. Getting an STD... a SEXUALLY transmitted disease? The only technically STD's you can get from piercings are HIV/AIDS and Hep C. The rest, like syphilis, chlamydia, herpes, etc. you can't get from piercings.

this is why i do research and talk to the owners of the place before i go and get myself a piercing. and i dont just settle on one place.

Salmenella I was just having this convo with my tattoo artist yesterday. People tend to look at us as "delinquents" when like said, the people who go into adulthood still in love with body mods are usually nothing like that. Story he told me. His wife and him were out at dinner (both heavily modified) when the table next to them, filled with older ladies, kept gawking at them. Finally one of the older ladies says "Excuse me, do you do tattooing for a living?"..he was expecting to get offended very soon when he said yes, she continues to tell him how her husband had a turtle on his shoulder that she HATED. He would always call her his frog though. He passed away recently and she wanted to know if she was too old to get a tattoo of a frog on her back (she was around her 60s/70s). After she told asked him this all her friends became more bitchy to even her. When my tattoo artist and his wife left they paid for those womens tab and had the waitress staple his card to the receipt with 10% off for the women that wanted the frog. When she went in later to get the tattoo she told him that that was all her friends could talk about for weeks. How those people (tattooed people in general) were some of the nicest, friendliest people out there and they were so wrong to judge. I loved that story rofl That's actually a really adorable story. I'm glad she came in to get it! Especially since her friends were stinkers about the idea, I'm glad she still came in and wasn't swayed from what she wanted.
