I think he is a husky. The reason as to why he is so small is the fact that he is still a puppy.

aww man, husky? I want to get a dog like hayate but the fact that he's a husky hinders me from getting one. It's hot as hell in my country (->live in Asia<-)
didn't they show how Riza got him in Brotherhood?

They didn't make an episode on it since the manga chapters never went into detail on Hayate's backstory. It was only with one of Arakawa's bonus comics that it was explained.

I believe it was on the Mustang crew finding a lost puppy and Riza training it to not pee on the wall. That is as much of a backstory to Hayate that I know of.
