This is now the main thread for the Alt. Constituion. The other thread was getting cluttered, so I have changed it to a pure discussion. This thread will contain the constitution, the other thread is where you discuss it PLEASE REMEMBER THIS! I don't want this one to get cluttered!

Article I- Dispertion of Power

The government will be divided into three branches:

Executive- The Executive branch contains the Pres. Vice. Pres, and Supreme Commander of the Armed Forces, along with the Cabinet containing the following offices:

Welfare of the State - Anti-Terrorism/Defense
Education
Agriculture
Inter-State Relations- Dealing with relations between the different states.
Public Works- Urban/Rural Development
Enviromental/Wildlife- Regulated the Enviromental policies, and national parks/wildlife refuges, as well as the status of endangered/extinct species.

Legislative- Contains 3 Branches
Senate
Representative Congress
People's Legislative Assembly-Detailed in a later article

Judicial- Contains a judge from each member state and a high judge elected by the other judges.

All Branches Detailed in Individual Articles






Article II- Power of the Branches- Detailed

President- The President has the power to propose and veto amendments to the constitution. He has the abilty to propose war. He may appoint officers to the posts of the cabinet pending senate approval. Must be 35 years of age, a natural born citizen and lived in the nation for at least 10 years. He is elected by a majority vote by the people. He will be limited to 2 five year terms.

Vice President- President of the Senate Presides Over Senate Sessions. Must be 30 years of age, and a natural born citizen of the Nation. Appointed by the president. May only be vice-president while the president who appointed him/her is president, until he/she is appointd by a future president or the president who appointd him/her term is up.

Supreme Commander of the Armed Forces- The Commander-In-Chief of the Armed Forces. He has the ability to propose war, and to porpose amendments dealing with the armed forces. He however does not have the power to veto amenments that are passed by congress. Appointed by a majority vote of the combined senate, house, and People's Assembly. Must be 35 years of age, and a natural born citizen, lived in nation for at least 5 years. Limited to an unlimited number of 5 year terms.

Senate- A single senator is elected by a majority of the people in his/her state. They must live in the state they run for, and must be 30 years of age. Each senator is limited to a 4 year term. Each Senator may propose amendments and acts.

Representive House- Along with the Senate approves and proposes amendments. They mst be 25 years of age and a citizen of the state they are running for. They have 2 year terms and may may propse laws and acts.

People's General Assembly- An assembly that is open to all citizens of the country over 18. This assembly may vote on laws passed by the house and senate. They may propose amendments. If a proposed amendment is accepted by a 2/3 majority, it passes to the House. This is elaborated on below.

All laws/amendments are passed by a 2/3 majority of the houses.

Judicial- Group of judges from each state. They form the highest court in the nation. They determine wheter passed amendments violate the Constitution of other amendments of the Constitution. If a law does, it will be removed, or rewritten. Rewritten laws must pass through the passing process.

Law/Act Passing Process:

A law may be proposed at any level, but it must start the passing process at the bottom.

People's Assembly votes on whether to pass.. if yes, passes to House, If No, act/amendment is struck down and may not be reproposed for 5 years.

House, should a law make it to the house, a majority vote will pass it to the senate.

Senate, If a bill makes it here, and they pass it, the president may choose to veto or sign the bill.

Pres, If signed the bill becomes law, and must within 2 years of passing be reviewed by the courts for constiutionality.

Courts- If it is constiutional it will continue to be in effect if not, it is removed, and must be rewritten or dropped. Should the court not make it to a bill, it is suspended until the can.

Judges, after appointed, are at their posts for 10 years. should they choose to step down before term is up, the state whose judge stepped down must elect a new one.

All members of all parts of the government are bound by the constitution. Should they be held in question of their actions, the People's assembly may vote for impeachment. If approved, the final decision of impeachment rest with a majority vote 3/4 of the supreme court.






Article III: Regional Government

Each state will have it's own congress that passes laws and amendments. The laws may not supersede any amendment in the national constitution. The state governments will be set up as a replica of the national goverernment except, they will not have a People's Assembly.






Artical IV: People's Rights

Quote:
The rights of the people are listed below, they may not be altered or suspended in any way.

1: All citizens have the right to Worship, Speak, and Talk as they wish.
2: Freedom of the Press wil not be restricted, the government may not restrict the rights of the press to publish.
3: All citizens have the right to bear arms for personal defense.
4: Slavery and Indentured Servitude is not allowed in any form.
5: No peoples may be discriminated because of Race, Religion, Gender, or Sexual Preferences, or denied their right to vote.






Article V: Limitations of Governmental Power
Quote:

Although organizations may be set up to regulate the ratings of Motion Pictures, Video Games, Books, Music and other Entertainment or Informational Mediums; the government and these organizations may not alter these because of their content. They can only rate them accordingly. The job of the ratings is to alert the purchasers of content, not to regulate what can and cannot be published.

The president may not enact any ordinances, amendments or laws without the approval of the legislative and judicial branches.

The government is allowed to regulate trade and taxes although only at a federal level, such as Income Tax and Social Security Retirement, and International trade. Interstate Trade and Property/Business Taxes may only be regulated by the state governements.






Article VI: Incorporating Cities and States:
Quote:

Cities may be incorporated by the approval of the states in whatever way is established by state laws. States may apply for statehood to the Senate. The Senate must approve this by a 3.4 majority vote of yes or no.






Article VII: Powers of the Cabinet
Quote:

Welfare of the State:
This department deals with the regulations of borders both land and sea, and the prevention of terrorist attacks by constitutional ways to be determined by the courts. They also regulate the defenses of the Nation, in ways such as building an army. The army may only be called on by the Supreme Commander pending approval by the People's Assemble approval.

Education: Regulates funding and curriculum of educational systems in the nation. They also regulate the tests given in schools. Curriculum across the nation should be standardized as well as the tests. A citizen is required to begin schooling at age 6 and must continue until age 18, with the option to pursue higher education.

Agriculture: Regulates growth of agricultural products. In same way as the current US Department of Agriculture. (To Be expanded)

Inter-State Relations (Interior Regulations) Body responsible for the welfare and communication of the Indigineuos tribes of the Nation.

Public Works: Responsible for the regulation of transportation, such as the building of roads, highways, and canals across the nation.

Environmental/Wildlife Protection: Regulates the use of the environment. Helps protect the enviroment, and wildlife. protection of endangered species and regulation of hunting and fishing main responisbilities.






Article VIII: Regulations
Quote:

Languages of communication will not be regulated however all official documents will be published and written in English due to it's current status as the universal language.

Measures will be written using the Metric System due to it's wider use, on government papers and road signs.






Article IX: The Clause of Peace
Quote:

The goal of this constitution would be a global government that divides the world into 7 States, one for each continent. In the event that the world were to be fully unified, and peace finally achieved any armed forces will be disbanded, and be made officially illegal within 5 years of the peace being achieved. The post of Supreme Commander would no longer be needed and would therefore cease to exist.






Article X: The Elastic Clause
Quote:

The government has the power to do whatever necessary to preserve the freedoms of it's citizens without infringing on their rights, or violating an amendment.






Article XI: Protection of Inventors
Formation of Copyright Bureau- Responsible for issuing patents!
Quote:

All Items invented and submitted to the Copyright Bureau will recieve a patent. These patents may be licensed by the inventor to earn money on a contract negotiated by the two parties. Punishment due to the violation of the contract will be determined by the severity of the breach. These patents do not need to be renewed and will be stored electronically and as a hard copy.
