It's legal. You just have to remember to include that nice little disclaimer that states you own nothing belonging to that which you are basing your story off of. (it's not like we're trying to make money off of this, you know?)
Shounen Jump is starting to publish Japanese fanfiction author's stuff, like for the Rurouni Kenshin series and a few others. Too bad they don't use some of the stories from this side of the world, lol.

There are a few exceptions though (mainly books) where authours have said it is not ok to do any sort of writing based on their work, sadly I can't remember which authours this is but I think the Pern series is one of thoose nono-worlds..
